OwnDesk is currently operated as a sole proprietorship in Canada. A separate corporation may be incorporated later; this notice will be updated accordingly.

3. Person responsible for the protection of personal information

In accordance with Quebec Law 25 (Act to modernize legislative provisions as regards the protection of personal information) and the General Data Protection Regulation (GDPR, European Union), the person responsible for the protection of personal information (RPRP, Quebec Law 25) is:

Any request to exercise rights (access, rectification, deletion, portability, limitation, objection) must be sent to this address. A response is provided within a maximum of 30 days.

OwnDesk has not appointed a data protection officer within the meaning of Article 37 GDPR, as such an appointment is not required given its processing activities. The contact above answers any question relating to data protection.

4. Hosting

Each entry lists the processor's legal entity (its registered head office), then the actual data processing zone (the location of the servers that host or process the data), which may differ from the head office.

All processing takes place in the United States, therefore outside Quebec and outside the European Union (see the “Transfer of data outside Quebec” section below). The complete list of processors and their processing zones is available in our privacy policy (article 4).

4a. Transfer of data outside Quebec

In accordance with Quebec Law 25 and Chapter V of the GDPR (European Union), OwnDesk informs you that almost all data processing takes place in the United States, therefore outside Quebec and outside the European Union. The processors involved in processing carried out in the United States are:

• Supabase (database, authentication, storage): region us-east-1 (Northern Virginia);
• Vercel (web and API hosting): region iad1 (Washington D.C. / Northern Virginia);
• Sentry (error monitoring): United States;
• Resend (transactional emails): United States;
• Stripe (payment processing): United States;
• Anthropic (artificial intelligence features): United States.

Such transfers are framed with contractual commitments requiring each processor to provide an equivalent level of protection (European Commission Standard Contractual Clauses for transfers subject to the GDPR, data processing agreements, and security measures). By using the Platform, you are informed of these transfers. For any question, write to support@owndesk.co.

5. Intellectual property

All source code, software architecture, the OwnDesk™ trademark, logo, graphic elements, AI prompts, textual content, videos, and any feature of the Platform remain the exclusive property of Fabien Barcelo (OwnDesk), without prejudice to user contributions governed by the Terms of Service.

Any reproduction, modification, distribution, public communication, translation, or exploitation, in whole or in part, without prior written authorization, constitutes infringement sanctioned by sections 27 and following of the Copyright Act of Canada (RSC 1985, c. C-42), as well as by applicable international conventions (Berne Convention, TRIPS).

OwnDesk is an unregistered trademark used professionally. Any unauthorized filing by a third party of the denomination “OwnDesk” or of a distinctive sign presenting a likelihood of confusion will be prosecuted.

OwnDesk is independent software. It is not affiliated with, endorsed or sponsored by CrossFit, LLC. CrossFit is a registered trademark of CrossFit, LLC. Other trademarks mentioned belong to their respective owners and are referenced for descriptive purposes only.

6. Regulatory compliance

OwnDesk designs and operates the Platform to comply with:

• Law 25 (Quebec) on the protection of personal information;
• the General Data Protection Regulation (GDPR) of the European Union;
• Canada's Anti-Spam Legislation (CASL) for commercial communications;
• the Consumer Protection Act (Quebec, CQLR, c. P-40.1) for consumer sales.

7. Cookies and trackers

OwnDesk uses no audience measurement tracker and no advertising cookie. The only cookies stored are those strictly necessary for the service to work — keeping your session open and remembering your light or dark theme — which, under Law 25 and the GDPR, do not require consent. No banner is therefore shown to you. You can clear these cookies at any time from your browser, or write to support@owndesk.co.

8. Applicable law

This legal notice is governed by the law in force in the province of Quebec (Canada) and by the federal laws of Canada applicable therein. Any dispute relating to this site falls within the jurisdiction of the courts of the judicial district of Montreal, subject to the public policy rules applicable to consumers.
